In the midst of a heated debate over alleged interference by intelligence agencies in judicial matters, Chief Justice of Pakistan (CJP) Qazi Faez Isa delivered a significant address to the Sindh High Court Bar Association (SHCBA) on Thursday.
Clarification Amid Controversy
The Chief Justice made clear that during his tenure as the country’s highest judicial authority, he has not received any complaints regarding meddling in the work of high court judges.
Allegations and Concerns
These remarks come at a crucial juncture as six judges from the Islamabad High Court (IHC) recently raised serious concerns about interference in judicial affairs by the intelligence apparatus. The judges outlined their apprehensions in a letter addressed to the Supreme Judicial Council (SJC). Signed by judges Mohsin Akhtar Kayani, Tariq Mehmood Jahangiri, Babar Sattar, Sardar Ejaz Ishaq Khan, Arbab Muhammad Tahir, and Saman Rafat Imtiaz, the letter detailed instances of pressure allegedly exerted on judges through abduction and torture of their relatives, as well as clandestine surveillance within their residences.
Government Response and Investigation
Following discussions between CJP Isa and Prime Minister Shehbaz Sharif, a commission was established to probe the allegations of interference, which received the cabinet’s approval. However, the former Chief Justice appointed to lead the commission, Tassaduq Hussain Jillani, recused himself from the matter. Consequently, the apex court took suo motu notice of the issue, indicating its gravity and importance.
Emphasizing Judicial Independence
CJP Isa, in his address, emphasized that any encroachment upon judicial independence would not be tolerated under his watch. He clarified that the incidents mentioned in the IHC letter occurred before his assumption of the role of Chief Justice, implying that he is not responsible for any such occurrences during his tenure.
